Terms of Service

Company: SepticStream ("SepticStream", "we", "us") Effective date: July 13, 2026

1. Agreement

By creating an account or using SepticStream (the "Service") you agree to these Terms. If you use the Service on behalf of a business, you represent that you may bind that business ("Customer", "you").

2. The Service

SepticStream is a software platform for septic, grease-trap, and related field-service businesses to manage customers, jobs, dispatch, inspections, invoicing, and messaging. We may update features over time.

3. Accounts & users

You are responsible for your account, your team members' accounts, and all activity under them. Keep credentials secure and notify us of any unauthorized use.

5. Customer data

"Customer Data" is the data you and your users put into the Service (including your own customers' contact details). As between us, you own Customer Data. You grant us a limited license to process it solely to provide and support the Service, as described in our Privacy Policy and Data Processing Addendum.

6. Messaging & telephony (SMS)

The Service can send SMS to recipients you designate, through our telephony provider (Twilio), under our shared sender. You are responsible for obtaining all required consent/opt-in from recipients, honoring opt-outs (STOP), and complying with the TCPA, CTIA guidelines, and carrier rules. We may suspend messaging for suspected non-compliance.

7. Acceptable use

Do not use the Service to break the law, send unlawful or unsolicited messages, infringe others' rights, or attempt to access another customer's data or our systems without authorization.

8. Third-party services

The Service integrates with third parties (e.g., Stripe, Twilio, Supabase, mapping providers). Your use of those is subject to their terms; we are not responsible for them.

9. Suspension & termination

We may suspend or terminate for non-payment, material breach, or risk to the Service or others. You may cancel anytime; cancellation stops future renewals. On termination you may export your data for 30 days, after which we may delete it.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND TO THE MAXIMUM EXTENT PERMITTED BY LAW. The Service is a business tool and is not a substitute for professional, legal, or regulatory compliance judgment.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, AND WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.

12. Indemnity

You will indemnify us against claims arising from your Customer Data, your messaging, or your misuse of the Service.

13. Changes

We may update these Terms; material changes will be notified. Continued use after the effective date means acceptance.

14. Governing law

The laws of the State of South Carolina govern these Terms, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in South Carolina.
